Conditions of Use
1. Scope and Conclusion of Agreement
The following terms are effective for all offers, deliveries and legal transactions incident to them. The quotations in this onlineshop are subject to change without notice and represent net prices in EURO. If applicable, the VAT will seperately be set in our invoice.
2. Delivery
All shipments are made for the account and at the risk of the buyer. PHARMASAAT GmbH does not take responsibility for any damages or losses caused by transport.
3. Packing
The products of PHARMASAAT GmbH are packed as usual in trade. Expenses for packing are passed to the customer's account.
4. Payment
The registered seat of the vendor is the place of payment. If no other agreements are made accounts have to be settled without any deduction within 20 days after the date of rendering. All goods remain in the ownership of PHARMASAAT GmbH until the customer has completely paid for then. If the customer is unknown or if there are doubts conceming his solvency the vendor will be entitled to deliver C.O.D. or to demand cash in advance.
5. Complaint (Obvious Faults)
Each sending is to be examined directly after receipt. Recognizable defects of ware and/or packaging must be objected within 7 workdays at the latest, whereas inadequate seed germination should objected not later than 3 weeks after receipt. Obvious faults made out later must immediately be complaines. If the buyer justly complains about recognizable defects or inadequate seed germination, the vendor - after his own decision - will take the ware back, grant a discount, undertake remedies, or perform a compansation delivery. The vendor does not take responsibility for the growing up and further development of plants, since some relevant effecting factors can not be influenced by him. In case of ligitation a representative sample is to be taken that will be sent to a suitable research institute for scrutinous examination.

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, you must inform us (PHARMASAAT Arznei- und Gewürzpflanzen Saatzucht GmbH, Am Westbahnhof 4, 06556 Artern, Tel.: ++49 3466 324599, Fax: ++49 3466 300231, Email: info@pharmasaat.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
7. Place of performance and legal domicile
is the seat of PHARMASAAT GmbH in Artern.The German law is valid for all business transactions.
8. Special Conditions
The minimum value is 27,00 EUR. If the worth of the ordered ware is less, PHARMASAAT GmbH will charge the customer for a rise of 6,00 EUR (for processing costs).
We will calculate:
the price stated for 10g for orders more than 5g
the price stated for 100g for orders more than 50g
the price stated for 1kg for orders more than 500g
The minimum order of seedings/layers should be 80 pieces. The minimum order of cuttings should be 50 pieces.
9. Responsibility
The PHARMASAAT GmbH do not take on responsibility for the successions of a false using of the plants in this shop. If you are ill or you have other complaints please contact your doctor or your pharmacist. You should use the plants of this shop only in a arrangement with a doctor or pharmacist. A false or abuse use could lead to physical damages. For editorial or technical mistakes and for the correctness of the declaration as well as damages through use of these plants, the PHARMASAAT GmbH do not accept liability.
Droit de restitution et de rétractation
Le client peut se rétracter de sa commande dans un délai de 2 semaines après réception de la confirmation de livraison respectivement de la livraison de la marchandise. La rétractation n’est pas nécessairement accompagnée d’un motif et peut être signifiée par écrit ou par renvoi de la marchandise dans le délai indiqué ci-dessus. Pour exercer votre droit de rétractation, vous devez nous informer de votre décision de rétractation du contrat par l’intermédiaire d’une déclaration claire (p. ex. une lettre envoyée par la Poste, un fax ou un courriel). Vous pouvez utiliser à cet effet le formulaire-type ci-joint, mais ce n’est pas obligatoire. Pour respecter votre délai de rétractation, il suffit d’expédier l’information concernant votre exercice de droit de rétractation avant l’échéance du délai respectif. Conséquences de la restitution
Dans le cas d’une restitution effective, les prestations reçues réciproquement et les jouissances exercées sont à rendre. Dans le cas d’une détérioration de l‘objet et pour des jouissances (p. ex. avantages d‘utilisation) qui ne peuvent pas être rendues dans leur totalité ou partiellement ou uniquement en état détérioré, vous devez réaliser une compensation à mesure. Une détérioration de l’objet doit être seulement compensée si cette détérioration résulte d’un maniement de l’objet qui dépasse l’inspection de ses propriétés et de son fonctionnement. Les obligations liées au remboursement des règlements perçus doivent être réalisées dans un délai de 30 jours. Ce délai démarre pour vous avec la réexpédition de la marchandise ou de la demande de reprise et pour nous avec la réception de la marchandise respectivement de la demande de reprise.
Conséquences de la rétractation
Si vous vous rétractez de ce contrat, tous les règlements perçus de votre part, y compris les frais d‘expédition (sauf les frais supplémentaires liés au fait que vous ayez choisi une autre forme de livraison que la livraison standard au prix avantageux proposée par nous) vous seront remboursés immédiatement et au plus tard sous quinze jours à partir de la date de réception de l’information concernant votre rétractation du contrat. Ce remboursement sera réalisé par le même mode de paiement utilisé lors de la transaction initiale, sauf si nous avions convenu expressément un autre mode. Dans aucun cas nous vous imputerons d’éventuelles rétributions financières liées à ce remboursement.
Nous avons le droit de refuser le remboursement tant que nous n’avons pas reçu la marchandise ou tant que vous n’ayez pas apporté la preuve du renvoi de la marchandise, la date faisant foi étant celle qui est la plus précoce entre les deux.
